Terms of Service
Effective date: November 5, 2026. Version 2026-11-05.
These Terms of Service govern access to Biocrafty (biocrafty.com), an AI service that writes and audits professional bios, passwordless accounts, and the purchase and use of generation credits. They form an agreement between:
Kertészné Martonosi Éva E.V. (sole trader), the legal operator of Biocrafty, registered address: 7621 Pécs, Majorossy Imre utca 4., Hungary; registration number: 56716942 (Hungarian sole trader registration number); tax number: 58086791-1-27; VAT identification number, where applicable: not VAT-registered, VAT-exempt small business (alanyi adómentes) (the "Operator" or "Biocrafty"), and the individual consumer who accepts these Terms electronically, identified by the email address of their Biocrafty account (the "User" or "you").
Customer support and privacy requests: support@biocrafty.com. The Privacy Policy explains how personal data is processed under the GDPR. Accepting these Terms and any consent needed for data processing are separate legal matters.
1. Acceptance, eligibility and definitions
1.1 Electronic acceptance. You accept these Terms by ticking the acceptance box when you sign in or register, and, for purchases, by completing checkout where the Terms are presented. You can read, download and save the Terms at any time on this page, and we send a purchase confirmation in a durable medium (email). Merely reading the Privacy Policy is not consent to processing that requires consent.
1.2 Eligibility. Biocrafty is for individual consumers who are at least 18 years old and have legal capacity to enter into this agreement. You must provide an email address you control. You may not register or use the Service on behalf of a person under 18.
1.3 Defined terms. "Service" means the Biocrafty website and its AI generation and audit functionality. "Credits" means prepaid units usable for generation requests. "Inputs" means the text you submit (for example profession, skills, achievements, or a bio to audit). "Outputs" means the bios, variations and audit results generated for you. "User Content" means your Inputs and Outputs. A "Generation" means one paid bio-generation job, including its automatic proofreading and length-checking steps.
2. Passwordless accounts and authentication
2.1 Email-only login. Sign-in uses only your email address, a one-time code we send to it, and a session cookie. Biocrafty does not ask for, collect or store account passwords or account-holder names. Payment records and User Content are kept separately from the sign-in record.
2.2 Email security and sessions. You must protect access to your email account and devices, keep sign-in codes confidential, and notify us promptly of suspected unauthorized access. The session cookie keeps you signed in; blocking or deleting it may require you to sign in again.
2.3 Account responsibility and recovery. You are responsible for activity you authorize and for reasonable precautions against misuse. Responsibility for unauthorized transactions remains subject to mandatory consumer and payment-services law. We may require proportionate verification before changing an account email, restoring access, or carrying out a sensitive request. Verification never requires a password or an account-holder name.
3. Generation process and service scope
3.1 AI bio generation. You can buy Credits and generate bios for supported platforms and languages. A Generation costs 1 Credit, which is shown on the page before you submit. The Bio Audit is free, within the usage limit shown on the page. Please review your Inputs before submitting.
3.2 Processing time. A Generation normally takes well under two minutes and is limited to a maximum of about 150 seconds. A job that does not complete successfully within that time is treated as failed. Please keep the page open until the result appears; we do not guarantee that a job can be resumed after you close it, but a failed job never costs a Credit.
3.3 Automatic restoration for failures. A Credit deducted for a Generation that fails for a technical reason is restored to the same Credit pack automatically. A successful Generation is not a failure merely because the wording differs from your preferences; defective or nonconforming performance remains subject to your statutory remedies. If a restoration does not appear in your balance, contact support.
3.4 Nature of Outputs. AI Outputs may contain inaccuracies, invented details, or similarities to other text. You must check every Output for accuracy and suitability before using it. Biocrafty provides writing suggestions, not career, legal or professional advice, and does not verify any claim in your bio. Actual service characteristics and express commitments made at checkout remain binding.
4. Credit purchases, prices and expiration
4.1 Pay-per-credit purchases. Biocrafty works on a pay-per-credit model. Checkout shows the number of Credits, the total price, the currency, applicable taxes, the payment method and any mandatory charges before you pay. Purchases never authorize recurring charges or automatic replenishment.
4.2 Payment processing. Payments are handled by Stripe (see Section 5 of the Privacy Policy). We may withhold purchased Credits until payment is confirmed and may correct an erroneous balance after explaining the correction and giving you the opportunity to challenge it.
4.3 Twelve-month validity. Purchased Credits expire 12 months after the purchase date, unless mandatory law requires a longer period or prohibits expiration. The expiration date is shown before purchase and in your account. Credits that expire first are used first. A Credit restored after a failed Generation keeps the expiration date of the pack it came from.
4.4 Credit restrictions and price changes. Credits are account-bound service entitlements, not a bank deposit, investment or transferable currency. They cannot be resold or transferred without our written agreement. Price changes apply to future purchases only; we will not reduce a purchased balance or shorten its validity.
5. Refunds, withdrawal and consumer remedies
5.1 No discretionary refunds. Unused Credits are nonrefundable, including where you change your mind or voluntarily close your account, except where mandatory law or an express remedy in these Terms requires reimbursement. Automatic restoration of Credits for failed Generations operates separately.
5.2 Statutory withdrawal. For an eligible EU distance contract you may withdraw within 14 days of conclusion without giving a reason. To do so, send an unequivocal statement to support@biocrafty.com or to the Operator's registered address before the withdrawal period ends (you can use the model notice at the end of the Refund Policy). We will reimburse amounts due within 14 days of receiving a valid withdrawal, using the original payment method, without a fee.
5.3 Immediate performance and separate consent. Credits make a digital service available immediately. Where immediate supply would extinguish or reduce a withdrawal right under applicable law, we first obtain your separate express consent to begin supply during the withdrawal period and your acknowledgment that you may lose the right of withdrawal (in whole or in part, as the law provides) once supply begins, and we confirm this in a durable medium. Acceptance of these Terms alone is not that consent. Where a service is performed at your express request during the withdrawal period, any proportionate charge and any loss of the right depend on the applicable statutory conditions, which we will identify before performance begins.
5.4 Nonconforming digital services. National laws implementing Directive (EU) 2019/770 may entitle you to have defective digital content or services brought into conformity free of charge and, where the statutory conditions are met, to a proportionate price reduction or termination and reimbursement. These rights apply independently of the refund policy, the Credit expiry and the liability provisions. See also our Refund Policy.
6. User Content and intellectual property
6.1 Your creations. You keep all rights you hold in your Inputs. To the extent Biocrafty acquires transferable intellectual property rights in Outputs generated specifically for you, we assign those rights to you upon successful generation and payment of the applicable Credits. If an assignment is legally unavailable, we grant you a worldwide, perpetual, royalty-free license to use, reproduce, modify, distribute and commercially exploit those rights.
6.2 Limits of AI ownership. Protection for AI-generated material depends on applicable law and the circumstances of creation. We do not promise that an Output is copyrightable, exclusive, or free of every third-party claim. The transfer in Section 6.1 covers rights held by Biocrafty, not rights belonging to others.
6.3 Limited operational license. You authorize us to process, reproduce and technically adapt User Content only as reasonably necessary to perform your requests, display and deliver Outputs, keep your saved bios in your account, maintain security, resolve support issues and satisfy legal obligations. We do not use User Content for model training, public promotion or public sharing without a separate opt-in authorization. To produce Outputs, your Inputs are sent to our AI provider, which processes them on our behalf (Section 5 of the Privacy Policy).
6.4 Platform rights and lawful Inputs. Biocrafty and its licensors keep their rights in the platform software, branding, interfaces and technology. You receive a personal, non-exclusive right to use the Service under these Terms. You must have the right to submit your Inputs and must not submit confidential information or personal data about another person without a valid basis and the necessary permissions.
7. Acceptable use
7.1 Prohibited conduct. You must use Biocrafty lawfully and may not:
- generate or distribute unlawful, exploitative, threatening, harassing, discriminatory or rights-infringing material;
- impersonate another person or invent qualifications, credentials, employers or achievements in order to deceive others;
- use the Service to create misleading content such as fake reviews or fraudulent profiles;
- attempt unauthorized access, defeat security safeguards, distribute malicious code or materially disrupt the Service;
- manipulate Credit balances or usage limits, abuse the failure-restoration mechanism, commit payment fraud, or evade an account restriction;
- extract protected platform technology, or conduct unlawful automated scraping, bulk use or reverse engineering.
7.2 Proportionate enforcement. We may reject a request or restrict access where reasonably necessary to address prohibited conduct, security risks or a binding legal requirement. Where lawful and practicable, we will explain the reason, preserve access to unaffected lawful content, and let you ask for a review through support. Urgent protective measures may come before notice.
8. Availability, changes and force majeure
8.1 Availability and updates. We use reasonable care and skill and provide the updates required to maintain conformity, including necessary security updates. Maintenance, network conditions and technical incidents may affect availability. Failed Generations are restored under Section 3.3.
8.2 Service modifications. We may make changes reasonably required for security, legal compliance, technical compatibility or improvement. Changes beyond those needed to maintain conformity must have a valid contractual reason, impose no additional cost for an existing entitlement, and be communicated clearly. If a change negatively affects your access or use beyond a minor degree, we will give advance notice in a durable medium and the termination rights required by the national law implementing Article 19 of Directive (EU) 2019/770, including the applicable 30-day termination opportunity.
8.3 Events beyond reasonable control. Neither party is liable for delay caused by an event beyond reasonable control that could not reasonably have been prevented, including a natural disaster, widespread infrastructure or provider failure, war, or binding government restriction. The affected party must take reasonable mitigation measures. This does not remove payment reimbursement, conformity remedies or termination rights required by law, and does not excuse keeping payment indefinitely for services that cannot be supplied.
9. Suspension, account closure and discontinuation
9.1 User-requested closure. You can delete your account yourself in the account panel, or ask us by email. Deletion removes your saved bios and sign-in sessions and closes unused Credits; you should copy any bios you want to keep first. Voluntary closure does not create a discretionary refund entitlement (Section 5.1), without affecting your statutory rights.
9.2 Termination for cause or legal prohibition. We may terminate an account for a material breach that remains unremedied after reasonable notice and an opportunity to cure, or immediately where the breach cannot be cured, involves serious harm or fraud, or continued service is prohibited by a binding order. Any withholding of prepaid value must be lawful and proportionate rather than an automatic forfeiture.
9.3 Closure without user fault. If we permanently discontinue the Service or terminate a paid account without your breach, we will give reasonable advance notice where possible, a reasonable opportunity to retrieve your bios, and reimbursement for unused purchased Credits. A sale, merger or transfer of the business does not by itself cancel purchased entitlements; any successor must assume the obligations or provide the corresponding remedy.
10. Liability and allocation of risk
10.1 Mandatory protections. Nothing excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, gross negligence where non-excludable, death or personal injury caused by negligence, mandatory digital-service remedies, or compensation under GDPR Article 82. Statutory consumer guarantees remain effective.
10.2 Foreseeable loss. Subject to Section 10.1, we are responsible for loss that is a reasonably foreseeable result of our breach of contract or failure to exercise required care and skill. You must take reasonable steps to limit avoidable loss. You are not required to indemnify us for our own wrongdoing.
10.3 Independent use decisions. You remain responsible for how you use Outputs, including checking facts, claims and permissions for your intended use. This does not reduce our obligations concerning promised functionality, data protection, security or conformity.
11. Support, complaints, governing law and general terms
11.1 Support and disputes. Support is available by email at support@biocrafty.com. You may submit a complaint identifying your account email, the transaction and the remedy you want, and we will first try to resolve it in good faith. Mediation or other alternative dispute resolution may be used by mutual agreement after a dispute arises; these Terms impose no mandatory arbitration and no waiver of access to courts. Competent consumer ADR body and any legally required participation disclosure: Baranya Vármegyei Békéltető Testület (Baranya County Conciliation Body), 7625 Pécs, Majorossy Imre u. 36., info@baranyabekeltetes.hu, www.baranyabekeltetes.hu. We are willing to take part in proceedings before it. EU consumers can also use the European Commission's online dispute resolution information at consumer-redress.ec.europa.eu.
11.2 European Union law and jurisdiction. These Terms are governed by applicable European Union law, supplemented by the national law of Hungary. This choice preserves the mandatory protections of the country of your habitual residence where applicable under Regulation (EC) No 593/2008. Court jurisdiction remains subject to Regulation (EU) No 1215/2012 and other mandatory rules; qualifying consumers keep their right to bring proceedings in their competent home courts.
11.3 Changes to Terms and notices. Material amendments are notified by email or another durable medium at least 30 days before taking effect, unless a shorter period is legally necessary. Amendments apply prospectively and cannot retroactively remove purchased rights. Where affirmative agreement is required, we obtain it. If you reject a materially adverse change, you may close the account and receive any reimbursement required for affected prepaid entitlements. Operational and legal notices may be sent to your account email; marketing consent is separate (we send no marketing).
11.4 Assignment, severability and entire terms. We may transfer this agreement with our business only if your contractual guarantees remain intact. You may not transfer your account without written agreement. If a term is unenforceable, the rest continues where legally possible, without rewriting an unfair term to the consumer's disadvantage. Failure to enforce a term immediately is not a waiver. These Terms and the transaction details accepted at checkout form the service contract, subject to mandatory law and binding precontractual representations.
11.5 Additional national disclosures. None beyond those stated in these Terms. Any addendum must preserve the EU consumer and data-protection rights stated here.
